We always have to sue your doctors' professional corporation where he works or the hospital where he works. Why? Because of a concept known as vicarious liability.
That means that the employer is responsible for the actions of their employees.
If your doctor is found liable for being careless and causing you harm, the doctor then becomes legally obligated to pay for your injuries. If he was employed by a hospital or a professional group, they are the ones who are legally liable to make that payment.
When you are an employer, the law says that you are responsible for what your employees do. If they are careless, then you, the corporation, will be held legally liable for their actions. That is why whenever a lawsuit against a doctor is started in New York, you will also notice that a professional corporation or a hospital is also included.
