Boris Johnson WILL ask Brussels for a Brexit extension! Government documents sent to the Court of Sessions in Edinburgh reveal that the government position is that it WILL send a letter the EU Council asking for an Article 50 extension, should there be no deal in place before the 19th of October.

On the face of it, the indications are that Brexit will now inevitably be delayed, if not cancelled in due course.

As news emerges that Boris Johnson will indeed, himself, Surrender to the Benn Surrender Act and send the letter begging Brussels for an Article 50 extension, if no deal is in place by the 19th of October.

This revelation emerged as lawyers line up in the Scottish Court of Sessions to get the court to rule that either the PM himself or a civil servant must send that letter.

Number Ten has so far refused to comment and the anti-Brexit legal team in Scotland, as far as I can make out, want a sworn statement from the PM that backs up the government documents they've seen.

This will give both the Remainer House of Commons and the EU all they need to reject every offer put forward by the PM.

His attempt to get the UK out of the EU by October the 31st is now over, done! Or so it seems.

But there will now definitely be no agreed Brexit deal.

But instead of a no-deal Brexit will we see yet another Article 50 extension while the Remainer MPs get their act together - not for a general election, but to engineer a second EU referendum in 2020?

As I've said before, the Remainers will not vote for no confidence in Boris Johnson and they will not vote for a general election.

Because both those options could throw up all sorts of spanners, especially if Boris won a majority in a General Election, or worse for Remainers if Nigel Farage and The Brexit Party for example end up holding the balance of power.

They are desperate to stay in there and take control of the House of Commons under these new precedents put in place by the outgoing Speaker, John Bercow, and then lay down legislation for that Referendum. And be in no doubt those of 16 years of age and over as well as EU27 nationals will be included in that electoral mix.

And the question of course will be between whatever deal is currently on the table at the time and revoking the Article 50 letter.

These Remainer MPs and Lords will do all they can to load the dice as heavily as possible against the Brexiteers. They've learnt their lesson from the last one.

And the EU, of course, will definitely agree to a further extension after January the 31st 2020 to allow that referendum to take place.

The only hope that Brexiteers have, is if Brussels turns down the extension request - fat chance of that happening, or if the new Speaker of the House of Commons, whoever that is, will play the rules of the House in a more 'traditional' manner - but, as that person will be voted in very soon by Remainers, you can't bet on that being the case - in fact I'd wager against it.

This could go down as the day we found out that it is all Boris Bluster and that there is no grand plan.

And unless Boris Johnson does something very very soon, we will watch as the support for both him and his party flatlines in the coming days and weeks.

And the major problem for Brexiteers is how on earth could we prevent this totally Remainer infested parliament legislating for another year's delay in order to conduct what will in the end be a totally one-sided referendum.

Unless, that letter could end up having zero effect by not delivering an Article 50 extension.

As far as I can tell, the documents only say that the letter will be sent - but there may be a legal way of ensuring no extension was ever put in place. But the legal memo also states that the UK government will not try and 'frustrate' the Benn Surrender Act - which raises real questions.
