youtube demands that You & All creators are obligated to take action & are legally required to comply with the Children's Online Privacy Protection Act (COPPA) after they got a $170 Million FTC Fine
the FTC is seeking input and comments on possible updates, some of which are specifically focused on how to address sites that aren’t necessarily aimed at children, but have large numbers of child users.
sites like YouTube that hid behind a terms of service, claim that YouTube is “not intended for children under 13”,
COPPA ONLY applies to operators of commercial websites and online services (including mobile apps) directed to children under 13 that collect, use, or disclose personal information from children. It also applies to operators of general audience websites or online services with actual knowledge that they are collecting, using, or disclosing personal information from children under 13. The Rule also applies to websites or online services that have actual knowledge that they are collecting personal information directly from users of another website or online service directed to children.
COPPA imposes certain requirements on operators of websites or online services directed to children under 13 years of age, and on operators of other websites or online services that have actual knowledge that they are collecting personal information online from a child under 13 years of age
Andrew Smith the Director of the FTC’s Bureau of Consumer Protection said
“We would have strong penalties in future cases against content creators and channel owners, as well — particularly when we would have a situation where the channel owner was specifically asked ‘are you child-directed?,’ and the channel owner said ‘No,” but bringing independent piecemeal actions against content creators, for violating COPPA, that may discourage content creators from posting content on YouTube so YouTube, plans to use AI to identify & automatically bucket videos featuring kids’ characters, toys and games, as also being children’s content & plans for a new $100 million fund for kid-friendly YouTube content, & block competition
& making COPPA Children’s Online Privacy Protection Act apply to individuals ?
or the FTC could Clarify their creepy definition of “child-directed,” & “child-attractive” content
Important: You're required , All creators are obligated to take action You're legally required to Use the new YouTube Studio to tell us if your videos are made for kids. & Review your channel and video settings.
fines up to $42,530 per video BUT if you mark your video as kid frindly this blocks, data collection , ad revenue , comments ,end screens , notifications & other features all because youtube was forbiden from collecting data in behavioral advertising from children under the age of 13 without explicit consent from their parents & did it anyway
my work is transformative in nature as a criticism so some usage of the original is required but uses no more of the original than is necessary & this has no negative affect on the market for the original work its self & my work is protected speech as outlined by the 1st amendment to the united states constitution & falls under fair use as outlined in united states copyright laws
